(i) THE PARTICULARS OF ORGANISATION, FUNCTIONS AND DUTIES :
 
  A

THE MAIN OBJECT OF THE PDEXCIL ARE:

    1.

To promote, support, develop, advance and increase powerlooms and export of powerloom fabrics and made-ups thereof and to carry out any such activity in such manner as may be necessary or expedient.

    2.

To undertake or assist in research in methods, designs, etc. and schemes of a technical nature intended to improve the efficiency of the powerloom sector.

THE OBJECTS INCIDENTAL OR ANCILLARY TO THE ATTAINMENT OF THE ABOVE MAIN OBJECTS OF THE PDEXCIL ARE :

    3.

To prepare edit, print, publish, issue, acquire and circulate books, papers, periodicals, gazettes, circulars and other literature having a bearing upon industry, trade or commerce pertaining to Indian powerloom fabrics.

    4.

To undertake market studies in foreign countries on & regular or on a ad-hoc basis.

    5.

To send Trade Delegations/Study Teams to foreign countries.

    6.

To appoint representatives, agents or correspondents in foreign countries for the purpose of regularly reporting trends in prices, market preferences and other connected matters.

    7.

To conduct publicity campaign so as to bring Indian powerloom fabrics to the notice of the dealers and the public in foreign countries and the advantages of trade and commerce with India in powerloom fabrics and made-ups thereof.

    8.

To collect statistics and other information regarding the manufacture and trade in powerloom products as also about powrlooms and employment in the powerloom sector.

    9.

To propagate, information useful to the Indian manufacturers, traders and exporters of powerloom products by Seminars, Lectures, Discussions, Books, Correspondence or otherwise.

    10.

To provide and regulate standards of quality and in packing in respect of powerloom fabrics and made-ups thereof intended for export.

    11.

To depute officers and members of the Company to carry out survey of powerloom industry in the small scale sector and other connected work.

    12.

To maintain liaison with any organisation that may be set up for inspection of powerloom fabrics and made-ups intended for export.

    13.

To enquire investigate and take remedial action on complaints, received from foreign importers or Indian Exporters in respect of the quality, description or other particulars of powerloom, fabrics and made-ups thereof manufactured and exported from India and other connected matters.

    14.

To make recommendations as may be necessary or expedient to the Central Government or State or Public Bodies like Chambers of Commerce on the basis of investigation of a complaint received by the Company or other wise in the interest of a complaint received by the Company or otherwise in the interest of the present or future development of powerlooms and export of powerloom fabrics and made-ups thereof from India.

    15.

To nominate arbitrators or valuers in the settlement of disputes and differences arising out of the transactions, relating to the exports of powerloom products between parties who agree to refer their disputes to the arbitrator/surveyors so nominated by the Company.

    16.

To communicate with Chambers of Commerce and other Mercantile and Public Bodies within or outside India for the promotion and advancement of the export of powerloom products.

    17.

To enunciate just and equitable principles to govern the trade in powerloom products and to establish a code or codes of practice for the general guidance of exporters and manufacturers and further to simplify transactions relating to the export of powerloom products.

    18.

To advise and/or represent to the Central or State Government, Local and other Authorities on:

      (a)

policies and other measures, including direct and indirect taxation.

      (b)

the steps to be taken by them to prevent any contravention of the code of practices laid down by the Company by any of the persons concerned, where such contravention would affect the export of powerloom fabrics and made-ups thereof.

     

Provided that such advice or representation shall be only in so far as such policies laid down by the Company by any of the persons concerned, where such contravention would affect the export of powerloom fabrics and made-ups thereof.

    19.

To establish and maintain museums, collections, libraries and compilation of literature and to translate, compile, collect, publish, lend, purchase or sell any literature connected with the trade and commerce relating to powerloom fabrics and made-ups thereof.

    20.

To borrow money from the Central of State Government or Banks or financial institutions and accept donations, grants or contributions form the Central Government, State Government, or other Public Bodies or Authorities or any other person and to deal with the same as the council may deem appropriate in the furtherance of its objects provided that the Company shall not deal with or use the funds or money received from the Central Government by way of grant borrowing or otherwise except in the manner or for the purpose specified by the Government, without prior written approval of such Government.

    21.

To grant subsidise, loans and advances to its employees or to the manufacturers or exporters of powerlooms products upon such terms and conditions, if in the circumstances and as approved by the Central Government and to realise and recover such subsidise, loans and advances in accordance with such approved terms and conditions thereof.

    22.

To sell, improve, manage, develop, exchange, loan, sublet, mortgage dispose of, turn to account or otherwise deal with all or any part of the property of the Company except that purchased with the Government grants which will be disposed of..

    23.

To enter into contracts, including guarantee.

    24.

To draw, make, accept, endorse, discount and execute, negotiable, instruments.

    25.

To deposit/invest the money of the Company in any bank approved in this behalf by Government.

    26.

To subscribe to become a member of and co-operate with any other Association whether incorporated or not, whose objects are similar to those contained in this memorandum.

    27.

To construct, purchase, hire or otherwise and maintain suitable buildings, apartments, furniture and other fittings in any country for the establishment of show-rooms, export of other agencies for publicity for the purpose of achieving any of the objects for which the Company is established.

    28.

To acquire, purchase or take on lease land, building or other movable or immovable property which the Company may from time to time deem it necessary to acquire, purchase or take on lease.

Provided that the Company shall not support with its fund, or endeavor to impose on or procure to be observed by its members or others any regulations or restrictions which, if an object of the Company would make it a Trade Union.

 
(ii) Export Promotion and development of the industry.
 
(iii & iv)

The Committee of Administration (COA) of the PDEXCIL decides the activities of the Council alongwith the budget for conducting the activities in the relevant financial year. The PDEXCIL office thereafter conducts the export promotion and development activities for the relevant financial year (not calendar year).

 
(v) Articles of Association of the PDEXCIL and other rules framed thereunder from time to time.
 
(vi)

The PDEXCIL receives communications/documents from various organizations and members of the Council as well as non members from the powerloom industry/textile industry. The documents are related to export promotion, development, fiscal and non fiscal issues. Some general queries and information is also desired from various persons/organizations directly or indirectly related with the PDEXCIL.

 
(vii)

The PDEXCIL invites suggestions from the members of the Council, members of the Committee of Administration of the Council regarding fiscal, non-fiscal, budget, foreign trade policy, etc. The same is done through newsletters, circulars, seminars, meetings, ordinary letters, E-mail and website of the Council. After getting the feedback from all the members of the trade, the PDEXCIL forwards the same to the Govt. of India, Govt. organizations and other organizations in matters relating to them.

 
(viii)

The minutes of the Committee of Administration (COA) are not open to the public at large/members. However, the same can be accessed if desired with the prior permission of the Council.
